Terms of service

Article n° 1 : Object
The terms of service hereunder details the rights and obligations between the company Gabriel Denneulin – Zorg Effects and his client in the sale of the following merchandises: Pedals Zorgtaver, Metalfe(s)t, Jour de FET, Oppressor, Bluffer, Glue Fuzz, Zorgverdrive Mosfet, Zorgverdrive, Love Philter.

Any service provided by the company Gabriel Denneulin – Zorg implies the consent without reservations of the buyer to the hereunder terms of services.

Article n° 2 : Prices
The prices of the merchandises sold are those in effect at the day of order. They're formulated in euros without VTA (Article 293B of CGI.)

The company Gabriel Denneulin – Zorg Effects grants itself the right to modify its prices at any time. However, the company engages itself to charge the merchandises ordered at the price indicated when the order was registered.

Article n° 3 : Discounts and rebates
The prices given comprises the discounts or rebates that the company Gabriel Denneulin – Zorg Effects might be offering to the customer.

Article n° 4 : Discount
No discount will be made in case of prepayment.

Clause n° 5 : Means of payment
The payment can be done:
  • by bank check ;
  • by credit card ;
  • by bank transfer ;
When registering the order, the buyer will be requested to pay 100% of the amount of the invoice, the merchandises will be engineered and sent at the reception of the payment.

Article n° 6: Property
The company Gabriel Denneulin – Zorg Effects keeps his right of property until full payment is made. As such, if the buyer is subject to reorganization or liquidation, the company Gabriel Denneulin - Zorg Effects reserves the right to claim, as part of the bankruptcy proceedings, the goods sold remaining unpaid.

Article n° 7 : Delivery
The delivery will be made by the following meanings :
  • By direct delivery of the merchandise to the buyer. ;
  • At the address given by the buyer on the order form.
Delivery delays given at order checkout are given as informations and is never guaranteed.

By means of consequences, any delay in the delivery of the products won't give the buyer any of the following benefit:
  • payment of damages or interests ;
  • cancelling of the order.
The transport risk is borne entirely by the buyer.

In case of missing or deteriorated merchandises during delivery, the buyer must make any reservations necessary on the order form at the reception of the merchandises. These reservations must be further confirmed in writing within five days of delivery by registered mail.

Article n° 8 : Force majeure
The responsibility of the company Gabriel Denneulin – Zorg Effects can not be applied if the non-execution or delay in performing any of its obligations described in these terms and conditions resulting from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible as defined in Article 1148 of the French Civil Code.

Article n° 9 : Court of competent jurisdiction
Any dispute concerning the interpretation and execution of these Terms of Services are governed by French law.
Failing amicable resolution, the dispute shall be brought before the Commercial Court of Toulouse, France.
